The objective of this study has been to establish the level of significance that Gustavo Gutierrez and Juan Luis Segundo attribute to politics in their contributions to liberation theology and to extract the relevant consequences for political theory. ;A systematic analysis of the theory of history in the works of these two authors indicates a higher level of integration between Christianity and politics that is usual in Christian political thought. Liberation is equated with salvation and political liberation is seen as (...) one of its components. This brings politics to a position of privilege. When at the service of justice it occupies, for our authors, a high rank among Christian concerns and when devoted to oppression it requires diligent response from every Christian. ;This understanding of politics is valuable in that it accentuates the political aspect of the Christian theory of history, an element frequently underestimated. Certain tensions remain, however, in the theory as a result of this emphasis: between the moral improvement expected from the involvement in political activities conducive to justice and the moral ambiguity of political structures emerging from such activity; and between the use of the concept of class struggle and notions of conversion and reconciliation. Finally, there is the danger of reducing the critical ability of Christians regarding a particular political project by identifying it with the concept of eschatology. (shrink)

¿Cómo debe entenderse que una de las innovaciones de mayor alcance epocal del pensamiento cartesiano, a saber, su duda metódica, no haya sido adoptada por la inmediata posteridad filosófica de Descartes? Este artículo investiga las razones de esta supuesta desaparición de la duda en las filosofías de Spinoza y Leibniz mediante una revisión del rol de la duda en las Meditaciones de Descartes. Partiendo de una caracterización del proyecto cartesiano como la búsqueda del fundamento, el artículo muestra que la interpretación (...) de Descartes de la realidad inmediata en términos de representación constituye en realidad la apoteosis de una concepción más antigua que percibe la totalidad de lo ente como contingente y vana. De este modo, la duda no es la suspensión libre del juicio, sino el inevitable estado de irresolución que se deriva de la falta de solidez ontológica que muestra la realidad inmediata entendida como imagen o representación. Se muestra entonces que el pensamiento postcartesiano propiamente no elimina la duda, sino que la incorpora como un supuesto básico, lo cual explica por qué no hay un lugar definido para la misma en el discurso. El desarrollo ulterior del pensamiento moderno puede ser explicado de modo decisivo por medio de esta asimilación implícita de la duda y sus consecuencias. (shrink)

El presente trabajo pretende establecer una íntima conexión entre el que considera un falso debate en torno a la modernidad y la posmodernidad y expresiones como fin de la historia, fin de las ideologías, y otras que desde ámbitos diversos vienen compitiendo por caracterizar el mundo actual. La hipótesis central es que esa constelación obedece a una lógica muy similar a la que llevó, a fines del XVIIII, a utilizar por primera vez el término nihilismo frente a la que consideraba (...) la Ilustración. La llamada posmodernidad no haría sino culminar esa tendencia, aunque en apariencia invirtiéndola mediante un mecanismo sutil fruto de la confluencia de tradiciones dispares como la filosofía analítica anglosajona o la hermeneútica. De esa inversión surgiría una nueva teología, atea, invulnerable en virtud de su "nihilismo", en la medida en que se asienta en la ausencia del fundamento, del referente o incluso de lo real mismo, y en cuyo seno se da incluso la apariencia de pluralismo o de la más plena secularización. A modo de ejemplo se contrastan los planteamientos básicos de Habermas y Foucault, en cuanto ya clásicos de ese debate, y como compartiendo esa teología desde posiciones en apariencia dispares. JUSTIÇA RESTAURATIVA: UMA ANÁLISE SOCIOLÓGICA DOS FINS QUE OS MEIOS PUNITIVOS NÃO ALCANÇAM.

Introduction Hospital delirium is a frequent, serious, costly, and underrecognized acute disorder of attention and cognition. Therefore, the prevention of hospital delirium is not only desirable for patients, caregivers, healthcare professionals, and the health system itself, but also a moral duty. Objective To identify and synthetize the main ethical aspects that arise related to the prevention of hospital delirium in patients 65 years and older. Methods A scoping review was carried out in Embase, Medline, and Web of Science. Articles published (...) in English or Spanish analyzing any pharmacologic, non-pharmacologic, or multicomponent intervention for prevention of delirium in hospitalized patients aged 65 years and over were included. Results Twenty-seven studies were included. Based on the frequency of appearance and the relevance, our findings were organized into three main areas. The first one was related to the principle of nonmaleficence and collected findings about the iatrogenic causes of hospital delirium and the use of restraints systems. The second area analyzed the impact of delirium in patients, families, and healthcare professionals from a relational ethics perspective, and addressed the family presence as a factor to prevent delirium. Finally, the third area is related to the quality of care. Conclusion Prevention of delirium in hospitals is essential to avoid the discomfort and potential clinical complications of patients, as well as the suffering of their relatives, caregivers, and healthcare professionals. Policymakers and healthcare managers are encouraged to make the required efforts to prevent delirium in hospitalized older patients. (shrink)

I argue that from a very weak recombination principle and plausible assumptions about the nature of parthood and location it follows that it's possible that the mereological structure of the material world and that of spacetime fail to correspond to one another in very radical ways. I defend, moreover, that rejecting the possibility of such failures of correspondence leaves us with a choice of equally radical alternatives. BackgroundUmbilical cord banks are a central component, as umbilical cord tissue providers, in both medical treatment and scientific research with stem cells. But, whereas the creation of umbilical cord banks is seen as successful practice, it is perceived as a risky style of play by others. This article examines and discusses the ethical, medical and legal considerations that arise from the operation of umbilical cord banks in Mexico.DiscussionA number of experts have stated that the use of umbilical cord goes beyond (...) the mere utilization of human tissues for the purpose of treatment. This tissue is also used in research studies: genetic studies, studies to evaluate the effectiveness of new antibiotics, studies to identify new proteins, etc. Meanwhile, others claim that the law and other norms for the functioning of cord banks are not consistent and are poorly defined. Some of these critics point out that the confidentiality of donor information is handled differently in different places. The fact that private cord banks offer their services as "biological insurance" in order to obtain informed consent by promising the parents that the tissue that will be stored insures the health of their child in the future raises the issue of whether the consent is freely given or given under coercion. Another consideration that must be made in relation to privately owned cord banks has to do with the ownership of the stored umbilical cord.SummaryConflicts between moral principles and economic interests (non-moral principles) cause dilemmas in the clinical practice of umbilical cord blood storage and use especially in privately owned banks. This article presents a reflection and some of the guidelines that must be followed by umbilical cord banks in order to deal with these conflicts. This reflection is based on the fundamental notions of ethics and public health and seeks to be a contribution towards the improvement of umbilical cord banks' performance. (shrink)

We study whether robots can satisfy the conditions of an agent fit to be held morally responsible, with a focus on autonomy and self-control. An analogy between robots and human groups enables us to modify arguments concerning collective responsibility for studying questions of robot responsibility. We employ Mele’s history-sensitive account of autonomy and responsibility to argue that even if robots were to have all the capacities required of moral agency, their history would deprive them from autonomy in a responsibility-undermining way. We will also study whether humans and technological artifacts like robots can form hybrid collective agents that could be morally responsible for their actions and give an argument against such a possibility. Various sources in the literature claim that the deduction theorem does not hold for normal modal or epistemic logic, whereas others present versions of the deduction theorem for several normal modal systems. It is shown here that the apparent problem arises from an objectionable notion of derivability from assumptions in an axiomatic system. When a traditional Hilbert-type system of axiomatic logic is generalized into a system for derivations from assumptions, the necessitation rule has to be modified in a way that (...) restricts its use to cases in which the premiss does not depend on assumptions. This restriction is entirely analogous to the restriction of the rule of universal generalization of first-order logic. A necessitation rule with this restriction permits a proof of the deduction theorem in its usual formulation. Other suggestions presented in the literature to deal with the problem are reviewed, and the present solution is argued to be preferable to the other alternatives. A contraction-and cut-free sequent calculus equivalent to the Hubert system for basic modal logic shows the standard failure argument untenable by proving the underivability of DA from A. (shrink)

La pena natural es una situación paradójica que se puede presentar cuando el autor de un delito, al cometerlo o a causa de éste, ha sufrido un daño igual o mayor al que padecería si el juez de la causa le aplicara la pena estatal prevista para tal conducta. Se da con frecuencia al juzgar ciertos accidentes viales, cuando el acusado ya carga el peso de ser quien, por imprudencia, mató a su pareja o familiar cercano, por ejemplo. Pero ¿en (...) qué situaciones y cómo cabe recurrir a la pena natural? En esta investigación, Manuel Serrano explora las diversas aristas y posturas en pugna que atraviesan este tema, donde se cruzan cuestiones como la idea de la “culpa compensada”, la prohibición de aplicar castigo doble por un mismo hecho (non bis in idem) y la clemencia judicial. El autor desmonta la estructura conceptual de la pena natural, estudia jurisprudencia argentina y recorre producciones teóricas de juristas que se han preocupado por este asunto complejo, profundo y poco abordado del derecho penal. Considerando que el transhumanismo es una particular deriva de la reflexión contemporánea, que sostiene la idea de que el actual estado de la humanidad no es el definitivo sino uno simplemente transitorio, que puede y debe ser intervenido tecnocientíficamente en procura de su mejoramiento, en este artículo se examinan las implicancias bioéticas y biopolíticas de tal presupuesto. Se atiende para ello a las complejas y dilemáticas circunstancias derivadas de la perspectiva transhumana, que están vinculadas con la probable trasgresión de los (...) derechos de las personas presentes o futuras y el eventual control absoluto de la vida como el que algunos de sus detractores afirman que inevitablemente se generaría a partir de semejante tipo de intervenciones biotecnológicas. Se intentará indagar críticamente en el ideario del transhumanismo tomando como referencia para el análisis la articulación indisoluble que en la modernidad se ha establecido entre el desarrollo de las tecnologías y aquella racionalidad política que sustenta las estrategias de la gubernamentalidad neoliberal. Se espera plantear con ello una inquietud y un conjunto de interrogantes respecto de los riesgos asociados a los modos hasta hora insospechados de producción, administración y control biopolítico de la subjetividad que podrían estar ligados inadvertidamente a la idea transhumanista. I give shape to a neglected debate in metaphysics, the debate over the ontological priority between individuality and collectivity. I distinguish the debate from more familiar ones in the recent literature and articulate what I call ontological collectivism, the view that collectivity is prior to individuality. I defend the in-principle intelligibility of the view from forceful general objections and argue that not only is it coherent but also of significant interest to the literature: it allows for overlooked alternatives on a (...) variety of central discussions. Sovereignty implies that there is no force that operates outside the power capable of regenerating and bring salvation to a people corrupt. Sovereignty involves the creation of a mirage, the manifestation of the free spirit of the people is a product or invention of state power. (...) The homogenization and depersonalization of the people is the result of the struggle to gain freedom and equality, but the intent for this freedom and equality does not entail the collapse of imperial force. La mal llamada “Conquista del Desierto” constituyó una serie de campañas militares ocurridas en el actual territorio patagónico argentino entre los años 1878 y 1885 cuyo resultado fue el asesinato, la violación y sometimiento a la esclavitud de diversos pueblos y comunidades indígenas. Este no fue un caso aislado, sino que se suma a una serie de ataques sistemáticos que han sufrido los indígenas en la Argentina. En los últimos años, a raíz del reclamo y las luchas de los pueblos (...) y comunidades indígenas, así como también de las organizaciones de derechos humanos, se han comenzado a juzgar algunos de estos hechos. En particular, la Masacre de Napalpí (1924) y la Masacre de La Bomba (1947) fueron los primeros que lograron respuestas judiciales favorables. En ambos se determinó que el accionar estatal era constitutivo de un genocidio y, por lo tanto, se debía resarcir a las comunidades actuales. Ahora bien, la Campaña del Desierto, al día de hoy, no tiene respuesta por parte del Estado. Teniendo presente este panorama, nuestro objetivo en este trabajo es reconstruir los diferentes problemas que enfrenta la posibilidad del reclamo judicial. Para ello, comenzaremos describiendo en qué consistió la Campaña del Desierto. Luego, explicaremos la noción de genocidio aplicado a hechos de injusticias históricas. Como tercer paso, reconstruiremos los casos jurisprudenciales que se han preocupado por genocidios indígenas ocurridos en el pasado. Con este panorama revelado, nos enfocaremos en los diferentes problemas jurídicos y políticos que surgen en los reclamos de justicia. (shrink)

I will study the concept of solidarity by looking at patterns of practical reasoning leading to behaviour that can be taken to exemplify solidarity. By studying which kinds of premisses are necessary for taking the motivation to display solidarity, in contrast to altruistic or moral motivation, I try to find necessary conditions for solidarity. I will argue that practical reasoning leading to solidary behaviour is a form of we-reasoning in which some of the premisses are in first person plural form (...) and attribute actions or attitudes to a collective. If this is correct, solidarity is a group concept, and intentional solidary behaviour presupposes identification with a group where others have shared goals or interests. This distinguishes solidary motivation and behaviour from altruistic or moral motivation and behaviour. (shrink)

Epistemic justification of non-summative group beliefs is studied in this paper. Such group beliefs are understood to be voluntary acceptances, the justification of which differs from that of involuntary beliefs. It is argued that whereas epistemic evaluation of involuntary beliefs can be seen not to require reasons, justification of voluntary acceptance of a proposition as true requires that the agent, a group or an individual, can provide reasons for the accepted view. This basic idea is studied in relation to theories (...) of dialectical justification in which justification is taken to require ability to justify. Since the reasons offered can in principle always be challenged, there is no ultimate end to the dialectical chain of justification. This makes justification of acceptance, and thus group belief, social and, in a way, contextual, but this does not seem to entail strong forms of epistemic relativism. (shrink)

Endorsing the idea of group knowledge seems to entail the possibility of group belief as well, because it is usually held that knowledge entails belief. It is here studied whether it would be possible to grant that groups can have knowledge without being committed to the controversial view that groups can have beliefs. The answer is positive on the assumption that knowledge can be based on acceptance as well as belief. The distinction between belief and acceptance can be seen as (...) a refinement of the ordinary language concept of belief, and it may be useful in understanding the nature of epistemic justification and classifying various types of epistemic subjects. Desde la concepción comunicativa del castigo, en este trabajo contestaré las siguientes preguntas: ¿El arrepentimiento significa un menor reproche penal o es indiferente para la determinación de la pena? en caso de que implique (...) un acercamiento al castigo mínimo establecido en la legislación ¿Cuándo es razonable que esto suceda? Resumen: En el presente artículo se propone una revisión de carácter descriptivo respecto a distintos momentos en los que el llamado giro semiótico de las ciencias sociales colinda con algunas categorías epistémicas fundamentales para la construcción de un proceso consciente de acercamiento a lo social. Así, la realidad como constructo discursivo, el carácter semiótico-perceptual de la observación, los procesos de transcodificación entre doxa y episteme o el peso estructural de la disciplina, serán los ejes fundamentales planteados para esta relación. A (...) partir de este planteamiento, se proponen como criterios de integración semiótico-epistémica dos paradigmas claves en la construcción de un proceso de investigación cualitativa: la adopción de estructuras interdisciplinarias y el enfoque de la complejidad, que permiten problematizar las categorías anteriores, integrándolas como elementos fundamentales en la organización social del sentido.: The present article proposes a descriptive review of those moments in which the social sciences semiotic turn borders with some epistemic categories that results fundamental for the construction of a conscious approach to the social. Thus, the reality as a discursive construct, the semiotic character of observation, the transcoding process between doxa and episteme, or the structural wealth of discipline will be presented as fundamental axes to this relationship. Based on this approach, there are proposed as semiotic-epistemic integration judgements, two fundamental keys in the construction of a qualitative research process: the adoption of interdisciplinary structures, and the complexity perspective that allows to problematize the previous categories, integrating them as fundamental elements in the social meaning organization. Purpose: To determine the relative value that patients place on consent for procedures in the emergency department (ED) and to define a set of procedures that fall in the realm of implied consent. Methods: A questionnaire was administered to a convenience sample 134 of 174 patients who were seen in the ED of a Midwestern teaching hospital. The questionnaire asked how much time they believed was necessary to give consent for various procedures. Procedures ranged from simple (venipuncture) to complex (procedural (...) sedation). Results: Participants valued a simple blood draw at a low mean of 1.02 minutes of extra time and a lumbar puncture at a high mean of 7.78 minutes. Of all participants 52% and 48% noted a time-value of ?0? time on blood draw and intravenous line starts, respectively, indicating that they desire no additional consent for these procedures. Conclusion: Defining a set of ED procedures covered under implied consent will be difficult because many patients value formal consent for even the simplest procedure. (shrink)

This article considers Edward W. Said’s proposals on ‘imaginative geographies’ as suggested in his leading work Orientalism as a tool to analyse the ideological circumstances that shape geographical spaces in the Bible. My purpose is to discuss how these imaginative geographies are present in the patriarchal narratives of Genesis and how they have left their mark on the history of the interpretation of these texts and on the not always easy relations between members of the religious traditions inherited from the (...) Bible (Hebrews, Muslims and Christians). I propose four types of ‘imaginative geographies’: (1) ‘Equalness’ is the way to represent what is considered as sharing the own identity. The geography of ‘Equalness’ defines the spaces of Isaac, Jacob and their families. (2) ‘Otherness’ is the way to represent the ‘Other’ as opposite or juxtaposed to one’s own identity. A common border is shared, thus kinship relationships can be established. It defines the spaces of Ishmael, Esau/Edom, Lot (Ammon and Moab) and Laban. (3) ‘Foreignness’ is the way to define what is strange, odd or exotic considered as external to the own identity, in a space set beyond even the space of the ‘Other’. Egypt is in Genesis a land of ‘Foreignness’. (4) ‘Delendness’ encompasses whatever claims our same space and therefore threatens our survival and must be destroyed ( delendum ). As such, processes of annihilation and dominion of Israel on Canaanites and Sichemites are justified. Contribution: The article applies Said’s ‘imaginative geographies’ as an identity mechanism for the creation of biblical literary spaces. A quadripartite classification (‘Equal’/‘Other’/‘Foreigner’/‘Delendum’) instead of the usual bipartite one (‘Equal’ vs. ‘Other’) is proposed and the consequences for the current coexistence between religious identities inherited from Abraham are shown. Estos elementos se interrelacionan por medio del ambiente sepulcral que se presenta en el texto, por medio de metáforas que los vinculan, y por medio de la forma en que se manifiestan en lo posible y lo imposible, cuya unión permite que lo (...) fantástico sea posible. La razón fundamental por la que, según cierto modelo historiográfico el Parménides platónico constituye un diálogo de crisis en el desarrollo del pensamiento de Platón, es la supuesta presencia en él de una crítica de la Teoría de las Ideas del período medio –Fedón, Banquete, República. La insuficiencia de esa teoría consistiría en una concepción de las Ideas como unidades absolutamente simples y completamente aisladas que les impediría cumplir la función para la cual habrían sido concebidas. Esa función solo podría (...) ser cumplida por una nueva concepción relacional de las Ideas que estaría sugerida en el Parménides y desarrollada en el Sofista. Así pues, por contraste con la que yo llamaría una estrategia del silencio, quisiera 1) insistir en que la noción de koinōnía es fundamental e imprescindible para el proyecto de la República, pues su tema central, la noción de justicia, es impensable sin la noción de koinōnía entre las Ideas; y 2) hacer notar el uso de esa noción de justicia en el Parménides, precisamente en conexión con la cuestión de la interrelación eidética y la concepción de la Idea como un todo “que ha surgido como un uno a partir de todos las partes – ἐξ ἁπάντων ἓν τέλειον γεγονός”.
